Debt Recovery & Enforcement Law in Türkiye

Unresolved debt and credit disputes are among the most stressful legal challenges an individual can face, carrying heavy financial, social, and personal burdens. An uncollected debt can severely disrupt your liquidity, while an unjust enforcement claim can immediately threaten your personal assets, bank accounts, and financial freedom. Navigating the rigid statutory deadlines and strict formal procedures of Turkish Enforcement and Bankruptcy Law requires prompt, highly precise legal action.

At Kotan & Gökce Law Firm, we represent foreign nationals in recovering outstanding debts or defending themselves against unfair financial claims in Türkiye. Our primary mission is to ensure you do not face unlawful financial sanctions, to secure your rightful funds swiftly, and to fiercely protect your legal assets through every phase of the enforcement process.

Our Scope of Services:

  • Initiating Debt Collection & Enforcement Actions: Filing and executing formal enforcement proceedings (icra takibi) to recover personal loans, unpaid invoices, or breach-of-contract damages.

  • Filing Formal Objections to Debt Claims: Lodging immediate legal objections against groundless or inflated debt notices to freeze enforcement actions.

  • Negative Declaratory & Restitution Lawsuits: Litigating court actions (menfi tespit) to prove you do not owe an alleged debt, or filing lawsuits (istirdat) to reclaim money that was unlawfully seized under coercion.

  • Asset Seizure & Asset Tracing Management: Overseeing or contesting asset attachments, including bank account freezes (bloke), salary attachments, property liens, and third-party debt notification letters (haciz ihbarnamesi).

  • Defense Against Unjust Attachments: Launching immediate emergency appeals and third-party ownership claims (istihkak davası) against wrongful property seizures.

  • Enforcement of Court Judgments: Executing both enforcement actions based directly on court orders (ilamlı) and general debt claims without prior judgments (ilamsız).

Swift and Strategic Debt Recovery:

We understand that time is of the essence when dealing with default debtors. We deploy rapid, aggressive asset-tracing and enforcement strategies under Turkish law to secure and liquidate available assets before they can be hidden.

Clear Protection Against Unjust Local Claims:

For foreign nationals unfamiliar with the Turkish legal system, a surprise debt notice can be terrifying. We provide clear, English-language strategic analysis to explain your rights and immediately intercept hostile collection actions.

Mastery of Strict Procedural Deadlines:

Turkish enforcement procedures move exceptionally fast. Our legal team meticulously monitors court calendars and statutory windows, ensuring that critical defense notices or asset-freezing appeals are filed without a single day's delay.

Critical Financial Risks for Foreigners in Türkiye

Receiving a groundless debt enforcement notice (Ödeme Emri) while unaware of the rules.

The Risk for Foreigners: Under Turkish law, if you receive a standard debt notice (ilamsız takip) and fail to file a formal, written objection within exactly 7 days, the debt becomes legally finalized—even if you have never heard of the creditor or do not owe a single Lira. Once this window closes, the claimant can immediately begin freezing your bank accounts and seizing your property. Immediate legal intervention is mandatory.

Facing a duplicate or fraudulent enforcement action for a debt you already settled.

The Risk for Foreigners: If a local counterparty initiates an enforcement action for a debt you previously paid, you must present airtight, formal proof of payment. If the statutory objection window has already closed, we must urgently file a Negative Declaratory Lawsuit (Menfi Tespit) in civil court to halt impending asset seizures.

Having your bank accounts or personal belongings wrongfully seized by authorities.

The Risk for Foreigners: If an enforcement office mistakenly seizes assets or property belonging to you to cover a debt owed by a third party (e.g., a former tenant or roommate), you cannot simply explain the mistake to the officers. A formal Third-Party Property Claim (Istihkak) must be filed swiftly in court to establish your rightful ownership and lift the attachment.
