If an employee develops a patentable invention within the scope of their employment or based significantly on company data, the company does not automatically own it. The employer must formally claim ownership and notify the employee within a strict 4-month statutory window from the date of internal disclosure. Failure to do so means full ownership reverts exclusively to the employee, leaving the company with only a basic, non-exclusive usage right.
